Appellant Douglas Strommen was convicted of attempted robbery in violation of Minn. Stat. §§ 609.17, subd. 1, 609.24 (2000).*fn1 He appealed the conviction, alleging several errors, including errors in jury instruction, prosecutorial misconduct, erroneous admission of evidence, insufficient evidence, and ineffective assistance of counsel. On appeal, the court of appeals concluded that the trial court erred by failing to instruct the jury on accomplice testimony, but that the error was harmless. The court of appeals also concluded that the trial court erred by admitting testimony that Strommen had killed someone in the past, however, the court of appeals concluded that this error was not plain error warranting reversal. The court of appeals ultimately affirmed Strommen's conviction. State v. Strommen, No. C9-00-1930, 2001 WL 1034929, at *1 (Minn. App. Sept. 11, 2001). We reverse and remand for a new trial.
